Terms of Service

These Terms of Service (“Terms”) govern access to and use of PicToText’s OCR platform, dashboard, API, and related services (collectively, the “Services”). By creating an account, initiating a subscription, or using any Service, you agree to these Terms and to our Privacy Policy at pictotext.io/privacy. If you are using the Services on behalf of an organization, you confirm that you have authority to bind that organization.
1. Eligibility & accounts
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. You are responsible for keeping credentials confidential and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access.
2. Services & usage limits
We grant you a limited, non-exclusive, non-transferable license to access the Services for lawful business or personal purposes. Rate limits, storage caps, and file-size restrictions vary by plan and may be updated with reasonable notice. You remain solely responsible for the content you upload and the legality of your use case.
3. Acceptable use
You agree not to: (a) violate any law or third-party rights; (b) upload malicious code, personal data without consent, or infringing content; (c) resell, reverse engineer, or misuse the Services; (d) interfere with security or performance; or (e) misrepresent your affiliation. We may suspend or terminate accounts that breach this section.
4. Payment terms
Paddle.com acts as our merchant of record and reseller. When you purchase credits or a subscription, you enter a contract with Paddle, which bills your selected payment method, calculates applicable taxes, and issues the invoice receipt. Prices are listed in USD unless stated otherwise and may change with 30 days’ notice for renewing subscriptions. You authorize Paddle to charge recurring fees until you cancel through your dashboard or Paddle’s customer portal. Late or failed payments may lead to suspension.
5. Refund policy
We provide a 14-day refund window from the original purchase for unused credits or unused subscription time. Refunds are evaluated case-by-case and cannot be granted for accounts that breached the acceptable use policy or consumed the majority of the purchased quota. To request a refund, email [email protected] or submit a ticket through Paddle with your order number. Approved refunds are processed through Paddle to the original payment method within 5–10 business days.
6. Intellectual property & user content
PicToText retains all rights to the Services, including software, branding, and documentation. You retain ownership of images and OCR output you upload or generate. By submitting content, you grant us a limited license to process, store, and transmit the content solely to provide the Services. You represent that you have all necessary rights to grant this license.
7. Data protection
Our Privacy Policy explains how we collect and process personal data, including data shared with Paddle and other processors. By using the Services, you agree to that policy. If you process personal data via our API, you act as the controller and must ensure you have a valid legal basis.
8. Service changes & availability
We may change or discontinue features to keep the Services reliable. Planned downtime will be announced in advance when possible. We are not liable for delays or outages caused by factors beyond our reasonable control, including third-party providers such as Paddle, hosting partners, or OCR engines.
9. Termination
You may cancel at any time through the dashboard or by contacting support. We may suspend or terminate access immediately if you breach these Terms, fail to pay, or pose security risks. Sections that by their nature should survive termination (payments owed, disclaimers, liability limits, IP, dispute resolution) remain in effect.
10. Disclaimers
Services are provided “as is” without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, accuracy of OCR output, or noninfringement. We do not warrant that Services will be uninterrupted, error-free, or free of harmful components.
11. Limitation of liability
To the fullest extent permitted by law, PicToText and any contributors will not be liable for indirect, incidental, special, consequential, or punitive damages, nor for any loss of profits, revenue, or data arising from or related to the Services. Our aggregate liability for any claim is limited to the fees paid to us (through Paddle) for the Service giving rise to the claim during the three months preceding the event.
12. Indemnification
You agree to indemnify and hold harmless PicToText and our affiliates from any claims, damages, liabilities, costs, and expenses (including attorneys’ fees) arising out of your content, your use of the Services, or your violation of these Terms.
13. Changes to Terms
We may update these Terms from time to time. We will notify you by email or in-app notice at least 10 days before material changes take effect. Continued use after the effective date constitutes acceptance of the revised Terms.
