Terms of Service

These Terms of Service ("Terms") govern access to and use of PicToText's OCR platform, dashboard, API, and related services (collectively, the "Services"). By creating an account, initiating a subscription, or using any Service, you agree to these Terms and to our Privacy Policy at pictotext.io/privacy. If you are using the Services on behalf of an organization, you confirm that you have authority to bind that organization.
1. Eligibility & accounts
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. You are responsible for keeping credentials confidential and for all activity that occurs under your account. Notify us immediately at support@pictotext.io if you suspect unauthorized access.
2. Services & usage limits
We grant you a limited, non-exclusive, non-transferable license to access the Services for lawful business or personal purposes. Rate limits, storage caps, and file-size restrictions vary by plan and may be updated with reasonable notice. You remain solely responsible for the content you upload and the legality of your use case.
3. Acceptable use
You agree not to: (a) violate any law or third-party rights; (b) upload malicious code, personal data without consent, or infringing content; (c) resell, reverse engineer, or misuse the Services; (d) interfere with security or performance; or (e) misrepresent your affiliation. We may suspend or terminate accounts that breach this section.
4. Payment terms
Purchases are processed by Paddle or Waffo, as identified at checkout and on your receipt. The selected provider acts as the merchant of record and authorized reseller for that purchase, collects payment, handles applicable taxes, and issues receipts or invoices under its buyer terms. PicToText provides the OCR service and related support. Prices are listed in USD unless stated otherwise; the final amount, including applicable taxes, is shown before payment. Credit packs are one-time purchases. Subscriptions renew automatically through the original payment provider until canceled. To stop a renewal, cancel through the billing dashboard or the original provider's customer portal before the cancellation deadline specified in that provider's applicable terms. Cancellation normally takes effect at the end of the current paid billing period and does not itself trigger a refund. Renewing subscription price changes will be notified at least 30 days in advance. Late or failed payments may lead to suspension.
5. Refund policy
Payments are final and non-refundable except where a refund is required by applicable law, the original payment provider's applicable buyer terms or refund policy, or refund rights attached to an earlier purchase. PicToText does not offer an additional voluntary refund window or automatic prorated refunds for unused credits, unused subscription time, or cancellation. Any discretionary refund request is assessed case by case and is not guaranteed. To request a review, email support@pictotext.io with your order number and the reason for your request, or contact the original payment provider through its support or buyer portal within the applicable request period. Approved refunds are issued through the original payment provider to the original payment method. Processing follows the timeframes required by applicable law and that provider's rules; the time for funds to appear also depends on your bank or payment method. Nothing in these Terms limits mandatory consumer rights, the payment provider's refund obligations or discretion, or rights attached to earlier purchases.
6. Intellectual property & user content
PicToText retains all rights to the Services, including software, branding, and documentation. You retain ownership of images and OCR output you upload or generate. By submitting content, you grant us a limited license to process, store, and transmit the content solely to provide the Services. You represent that you have all necessary rights to grant this license.
7. Data protection
Our Privacy Policy explains how we collect and process personal data. We share account and order information needed to complete and manage your purchase with the payment provider you use. That provider processes billing and payment data under its own privacy policy. By using the Services, you agree to our Privacy Policy. If you process personal data via our API, you act as the controller and must ensure you have a valid legal basis.
8. Service changes & availability
We may change or discontinue features to keep the Services reliable. Planned downtime will be announced in advance when possible. We are not liable for delays or outages caused by factors beyond our reasonable control, including third-party payment providers, hosting partners, or OCR engines.
9. Termination
You may stop using the Services at any time. To stop subscription renewals, cancel through the billing dashboard or the original payment provider's customer portal, subject to the timing described in Section 4. You may contact support for assistance. We may suspend or terminate access immediately if you breach these Terms, fail to pay, or pose security risks. Sections that by their nature should survive termination (payments owed, disclaimers, liability limits, IP, dispute resolution) remain in effect.
10. Disclaimers
Services are provided "as is" without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, accuracy of OCR output, or noninfringement. We do not warrant that Services will be uninterrupted, error-free, or free of harmful components.
11. Limitation of liability
To the fullest extent permitted by law, PicToText and any contributors will not be liable for indirect, incidental, special, consequential, or punitive damages, nor for any loss of profits, revenue, or data arising from or related to the Services. Our aggregate liability for any claim is limited to the fees you paid for the Service giving rise to the claim through any supported payment provider during the three months preceding the event.
12. Indemnification
You agree to indemnify and hold harmless PicToText and our affiliates from any claims, damages, liabilities, costs, and expenses (including attorneys' fees) arising out of your content, your use of the Services, or your violation of these Terms.
13. Changes to Terms
We may update these Terms from time to time. We will notify you by email or in-app notice at least 10 days before material changes take effect. Continued use after the effective date constitutes acceptance of the revised Terms.
